When you are arrested for DWI, BWI, or DUI, the state prosecutes a criminal case against you and a civil license suspension case, also called an ALR case (Administrative License Revocation).  ALR cases can be won and it is important to fight these suspensions. Please don’t forget you only have 15 DAYS from the date of your arrest to request the ALR hearing.  The potential suspension lengths are:

ADULTS

REFUSAL:  If you refused to give a breath or blood sample, even if the police took a blood sample under the authority of a warrant, the suspension lengths are:

  • 180 DAYS     First Offense
  • 2  YEARS     If you have a previous drivers license suspension for failing or refusing a breath or blood test or a previous suspension for DWI, Intoxication Assault, or Intoxication Manslaughter during the 10 years before your date of arrest.

FAILURE:  If your breath or blood test result was .08 alcohol concentration or greater, then the suspension lengths are:

  • 90 DAYS      First Offense
  • 1 YEARS       If you have a previous drivers license suspension for failing or refusing a breath or blood test or a previou suspension for DWI, Intoxication Assault, or Intoxication Manslaughter during the 10 years before your date of arrest.

MINORS

REFUSAL:  If you refused to give a breath or blood sample, even if the police took a blood sample under the authority of a warrant, the suspension lengths are:

  • 180 DAYS      First Offense
  • 2 YEARS       If you have a previous drivers license suspension for failing or refusing a breath or blood test or a previous  suspension for DWI, Intoxication Assault, or Intoxication Manslaughter during the 10 years before your date of arrest.

FAILURE:  If your breath or blood test shows any detectible amount of alcohol, the suspension lengths are:

  • 60 DAYS      First Offense
  • 120 DAYS    If you have a previous conviction for DUI, DWI, Intoxication Assault, or Intoxication Manslaughter.
  • 180 DAYS   If you have two or more previous convictions for DUI, DWI, Intoxication Assault, or Intoxication Manslaughter.
